Note, there are TWO issues, the one decided Tuesday night was a given, as SunCal has already defaulted on payments for the Mobile Home land, and that SunCal also stopped backing the lawsuit that Disney had filed against the city.

A second measure is still on the June 2008 ballot, and that is the initiative that deals with the entire resort area, and that if approved, will require multiple steps, including a vote by the registered voters of Anaheim if they want to change the zoning for something other than commercial or tourism use.

This battle will be fought over the next 6 months or so, and will be funded in large part by Disney to get it approved. But with SunCal pulling out, not sure how much will be spent against the measure, though a couple of landowners are looking to get a zoning change. But I doubt they will invest much in the fight.

Not according to the article:

As I recall, there were two separate referenda on the June ballott. One dealt with the SunCal property. That has been pulled, as the decision to disallow the zoning change obviates it.

The more general referendum on zoning is separate, and was not pulled.

That's my understanding.

The Coalition to Protect and Defend Anaheim quietly filed Tuesday a notice of intent to gather signatures for the measure to give voters say over any development proposal on a 52.9-acre, Disney-owned plot, mostly a strawberry field where a theme park or other venue could go.

The coalition was started and funded by SunCal, a developer that planned to build 1,500 homes across from the Disney property, spending more than $700,000 on its campaign through September.

Now that SunCal's deal is falling apart, coalition members decided to pursue the initiative anyway, said Diane Singer, the coalition's chair. Singer said the group is seeking other funding sources, adding that she has not recently spoken to SunCal officials.

"The issue still remains that residents are concerned about Disney having too much power and having too much control over government," Singer said.<<

So we have the SOAR Initiative on the ballot for sure (no way to remove it, as it a citizens proposal and is not directly related to a city council action). And now maybe the CDPA Initiative (but I doubt they will get enough signatures, especially with no real source of financing).

Here is a link to the cross-complaint lawsuit filed by the Frank Family against SunCal, and discusses the actual contract and extensions that were made, and how SunCal failed to live up with the original terms (reducing the purchase price by $10 million) and all the additional deals made, and how SunCal failed to make the October 2007 payment, and the reasons why SunCal lost the rights to purchase the property.

I think suncal has not a leg to stand on.

I don't think they'll have to pay anything in damages, either.

And because the ordinance was repealed, there's no need for the referendum to be on the June ballot. WE WON!!! A complete victory for preserving the Anaheim Resort District!

And they did this because you stood up and said NO!!

SOAR applauds the City Council for listening to the tens of thousands of Anaheim residents and ending the debate over this ill-conceived Resort District housing project.

It means the Resort District - which covers less than five percent of the City yet generates more than half of all city tax revenues - has a green light to continue expanding tourism uses and tourism revenues for our city.

These revenues are funding street repairs, police officers, firefighters, maintenance of our parks and other important city programs.

Every resident of Anaheim benefits from these programs.

Not yet! There are still some developers considering housing proposals for the Resort District. For this reason SOAR will continue the fight for the SOAR Initiative that requires ALL such proposals to go before the voters -- after a full environmental review and public hearings.

Please help your friends and neighbors in SOAR Preserve the Resort District and help us ensure an overwhelming victory for the SOAR Initiative in June.

Darkbeer, it's interesting that Jubal over on ocblog.net has gone very silent on this one.

This is a classic case of a sleazy developer showing up selling snake oil, misjudging the local marketplace by a mile, and then slithering out of town very quietly and trying to blame the locals for their mistakes.

It's just a shame a couple of amateur-hour city council members got in on the sales pitch too and gave this more energy than it deserved. But since it was doomed to fail anyway, all the city council did was extend the pain, rack up some big legal bills, and embarass their city in the process.
