PORT ST. LUCIE - Melissa Barton said she is considering legal action after her son's kindergarten teacher led his classmates to vote him out of class.
After each classmate was allowed to say what they didn't like about Barton's 5-year-old son, Alex, his Morningside Elementary teacher Wendy Portillo said they were going to take a vote, Barton said.
By a 14 to 2 margin, the students voted Alex - who is in the process of being diagnosed with autism - out of the class.
Melissa Barton filed a complaint with Morningside's school resource officer, who investigated the matter, Port St. Lucie Department spokeswoman Michelle Steele said. But the state attorney's office concluded the matter did not meet the criteria for emotional child abuse, so no criminal charges will be filed, Steele said. |

Had I read this story say 3 weeks ago, I would have been offended, but being that just 2 weeks ago my own 7 year old son was diagnosed with Dyxlexia (yeah I know it's not autism and from the outside he doesn't seem any different, still.) Now I am far more sympathetic and empathetic to parents of and children with ANY kind of special need.
I have never sued anyone for anything, but I would be minimum demanding this teachers license be revoked by whatever state.
How stupid can one teacher be? |

That may be the case. But of course, that should be handled amongst adults -- his parents and educators, not in a humiliating "vote" such as this.

It would be fitting to have other teachers all state what they don't like about her in a public setting, then have a vote to see if she should be allowed in a classroom ever again. |
